Authorities are not charging the women with killing the patients, but state that said their conduct “recklessly endangered” the patients’ lives and in the indictments described the actions as playing the “angel of death.” The ex-nurse, Marty Himebaugh, has been indicted on six felony charges, including criminal neglect of residents, fraudulent prescriptions, and distribution of a controlled substance. Director Penny Whitlock was also charged with criminal neglect and obstruction of justice. Authorities have said that Whitlock encouraged Himebaugh to give medication to the patients and then told another employee to destroy the evidence. If convicted, both women face up to three years in prison. The arrests have comforted at least one family, whose loved one was under the care of Himebaugh. Vickie Cole, who passed away in 2006 at the age of 78, was allegedly given morphine the day of her death at a time when she was unresponsive with delayed breathing. For her family and the others, they can only hope that these trials will bring justice for the victims.
